Terms of Service

Welcome to KeyImagery (https://www.keyimagery.com). By accessing our web portal or using our photography and videography services, you agree to be bound by the following terms.

1. Services & Account Registration

KeyImagery provides professional visual media services and a digital hosting portal.

  • Eligibility: You must provide accurate information during sign-up.
  • Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
2. Media Hosting & Access

We host visual content on our private, in-house servers in Hamilton, NZ.

  • Public Galleries: If a client requests a gallery be "Public," KeyImagery is not liable for how third parties download or use images accessed from that gallery.
  • Private Galleries: Access codes and authenticated logins are provided for your security. You agree not to share these credentials with unauthorised individuals.
  • Client Uploads: If you upload your own media to our portal, you represent that you own the rights to that content and that it does not violate any laws.
3. Intellectual Property Rights
  • Ownership: Unless otherwise agreed in a written contract, KeyImagery retains the copyright to all images and videos produced by us.
  • Usage License: Upon full payment, clients are granted a non-exclusive license to download, use, share, and print the media for any purposes.
  • Portfolio Rights: KeyImagery reserves the right to use any images or videos produced by us for promotional, marketing, and portfolio purposes. Clients may request to opt-out of this usage by submitting a written request.
4. Payments & Refunds
  • Processor: All digital transactions are processed securely via PayPal.
  • Order Fulfillment: Physical orders are processed in-house. Delivery times are estimates and may vary based on courier availability.
  • Refunds: Due to the digital nature of our services, refunds for digital downloads are generally not provided once the file has been accessed. For physical goods, please contact us within 7 days of receipt if the item is damaged.
5. Prohibited Conduct

Anyone using the KeyImagery portal agrees not to:

  • Attempt to bypass gallery security or access codes.
  • Use the portal to host or distribute illegal, defamatory, or infringing content.
  • Scrape data or images from the site using automated tools.
6. Limitation of Liability
  • Data Loss: While we keep files for a minimum of 5 years on our private servers, KeyImagery is not a permanent backup service. We encourage users and clients to download and back up their media locally. KeyImagery is not liable for data loss due to hardware failure or unforeseen technical issues.
  • Service Availability: We strive for 100% uptime, but we do not guarantee that the web portal will be error-free or uninterrupted.
7. Termination of Use

We reserve the right to suspend or terminate access to the portal for users who violate these terms, fail to make payments, or engage in unauthorised use of the content.

8. Governing Law

These terms are governed by and construed in accordance with the laws of New Zealand. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in New Zealand.

9. Changes to Terms

KeyImagery may update these Terms of Service from time to time. Continued use of the portal after changes are posted constitutes acceptance of the new terms.
